Terms of Service

These Terms govern your use of CrewVerify, operated by Remergify ("we," "us"). By creating an account or using the service, you agree to these Terms. If you're agreeing on behalf of a company, you represent that you're authorized to bind that company.
1. The service
CrewVerify is a workforce check-in and attendance tool. It lets businesses manage job sites and workers, lets workers check in by phone with location verification, and produces attendance records, alerts, and exports.
2. Accounts
You're responsible for the accuracy of your account information, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at support@checkinsites.com of any unauthorized use.
3. Acceptable use
You agree not to: use the service unlawfully; use it to track individuals outside a legitimate employment/workforce relationship; misrepresent identity; attempt to breach security or access data that isn't yours; or interfere with the service's operation.
Your responsibility regarding workers: If you use CrewVerify to track workers, you are responsible for complying with all laws that apply to you, including notifying workers about location collection and obtaining any consent their jurisdiction requires. You — not us — are the employer and the party responsible for your employment practices and records.
4. Worker data and your obligations
You acknowledge that GPS location and attendance data are sensitive. You agree to use them only for legitimate workforce-management purposes, to inform your workers, and to comply with applicable privacy, labor, and wage laws (including prevailing-wage and certified-payroll rules where they apply to your projects).
5. Fees and billing
Paid plans are billed per worker per month (or as otherwise described at signup), through our payment processor. Fees are billed in advance and are non-refundable except where required by law or expressly stated. We may change pricing with reasonable notice; changes apply to the next billing cycle. Add-ons are billed in addition to your base plan.
6. Free trials
If we offer a free trial, we may require a payment method to start a paid plan afterward. We'll make trial terms clear at signup.
7. Data ownership and export
As between you and us, your account data (your sites, workers, and check-in records) belongs to you. We hold it to provide the service. You can export your check-in records at any time. On account closure, you may request an export; after a reasonable period we may delete the data, subject to legal retention requirements.
8. Service availability
We work to keep CrewVerify available and reliable, but we provide it "as is" and "as available." We don't guarantee uninterrupted or error-free operation. We may modify or discontinue features with reasonable notice.
9. Disclaimers
CrewVerify is a tool that records check-in data based on information provided by devices (including phone GPS), which can be inaccurate or manipulated. We do not guarantee that every record is accurate or that the service will detect every instance of fraud, substitution, or error. The service is not legal, tax, or compliance advice. You're responsible for verifying records before relying on them for payroll, compliance, or legal purposes.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, REMERGIFY LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your use of the service, your worker-management practices, or your violation of these Terms or applicable law.
12. Termination
You can cancel anytime. We may suspend or terminate accounts that violate these Terms or that pose a security or legal risk. On termination, your right to use the service ends; the sections that by their nature should survive (fees owed, disclaimers, liability limits, indemnity) survive.
13. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in New Jersey, unless otherwise required by law.
14. Changes to these Terms
We may update these Terms. Material changes will be posted with a new effective date and, where appropriate, communicated to account holders. Continued use after changes means you accept them.
